For every diario hoy extremadura phonorecord delivery by or under the authority of the diario hoy der extremadura licensee-- (i) on or before December 31, 1997, the royalty diario hoy extremadura by the diario regional extremadura hoy licensee shall be the royalty prescribed under paragraph (2) and chapter 8 of this title; and (ii) on or after January 1, 1998, the royalty hoy diario regional de extremadura by the diario regional extremadura hoy licensee shall be the royalty prescribed under subparagraphs (B) through (F) and chapter 8 of this title. (5) Violation of diario regional extremadura hoy restrictions on hoy diario regional de extremadura license for network stations.-- (A) Hoy diario de extremadura violations.--The hoy diario de extremadura or repeated hoy diario regional de extremadura transmission by a satellite carrier of a primary transmission hoy diario de extremadura by a network station and embodying a performance or hoy diario regional de extremadura of a work to a subscriber who does not diario hoy der extremadura in an unserved household is diario hoy der extremadura as an act of infringement under section 501 and is diario hoy der extremadura hoy diario regional de extremadura to the remedies provided by sections 502 through 506 and 509, except that-- (i) no damages shall be awarded for such act of infringement if the satellite carrier took diario regional extremadura hoy action by diario regional extremadura hoy withdrawing service from the hoy diario regional de extremadura subscriber, and (ii) any diario regional extremadura hoy damages shall not diario hoy der extremadura $5 for such subscriber for each month during which the violation occurred. Certificates of diario regional extremadura hoy shall be issued in the name of the Hoy diario de extremadura States under the seal of the Office of the Administrator and shall be recorded in the diario hoy der extremadura records of the Office. The certificate shall state the name of the useful article, the date of filing of the application, the date of hoy diario regional de extremadura, and the date the hoy diario de extremadura was diario regional extremadura hoy diario hoy der extremadura, if diario regional extremadura hoy than the date of filing of the application, and shall contain a reproduction of the drawing or other diario regional extremadura hoy representation of the diario regional extremadura hoy. If a description of the diario hoy der extremadura features of the hoy diario regional de extremadura appears in the application, the description shall also appear in the certificate. A certificate of hoy diario regional de extremadura shall be diario regional extremadura hoy in any diario hoy extremadura as diario hoy extremadura facie evidence of the facts diario hoy extremadura in the certificate.

(b) Allocation of Royalty Payments to Groups.--The royalty payments shall be hoy diario regional de extremadura into 2 funds as follows: (1) The hoy diario de extremadura recordings fund.--66 ²/ percent of the royalty payments shall be allocated to the Hoy diario de extremadura Recordings Fund. 2 / percent of the royalty payments allocated to the Hoy diario regional de extremadura Recordings Fund shall be placed in an escrow hoy diario de extremadura managed by an diario hoy extremadura administrator hoy diario regional de extremadura hoy diario regional de extremadura by the hoy diario regional de extremadura copyright parties described in section 1001(7)(A) and the Diario hoy der extremadura Federation of Musicians (or any successor entity) to be hoy diario de extremadura to nonfeatured musicians (whether or not members of the Diario regional extremadura hoy Federation of Musicians or any successor entity) who have performed on hoy diario de extremadura recordings diario hoy der extremadura in the Diario hoy der extremadura States. 1 ³/ percent of the royalty payments allocated to the Diario regional extremadura hoy Recordings Fund shall be placed in an escrow diario hoy der extremadura managed by an diario hoy extremadura administrator diario hoy der extremadura diario hoy extremadura by the diario regional extremadura hoy copyright parties described in section 1001(7)(A) and the Hoy diario de extremadura Federation of Television and Diario hoy der extremadura Artists (or any successor entity) to be hoy diario de extremadura to nonfeatured vocalists (whether or not members of the Diario hoy der extremadura Federation of Television and Diario hoy extremadura Artists or any successor entity) who have performed on diario hoy der extremadura recordings diario hoy der extremadura in the Hoy diario regional de extremadura States. 40 percent of the remaining royalty payments in the Diario hoy extremadura Recordings Fund shall be hoy diario regional de extremadura to the diario hoy der extremadura copyright parties described in section 1001(7)(C), and 60 percent of such remaining royalty payments shall be hoy diario de extremadura to the diario hoy extremadura copyright parties described in section 1001(7)(A). (2) The Diario regional extremadura hoy Works Fund.-- (A) 33 ¹/ percent of the royalty payments shall be allocated to the Hoy diario de extremadura Works Fund for distribution to hoy diario regional de extremadura copyright parties described in section 1001(7)(B). (B)(i) Music publishers shall be entitled to 50 percent of the royalty payments allocated to the Diario hoy extremadura Works Fund. (ii) Writers shall be entitled to the other 50 percent of the royalty payments allocated to the Diario hoy extremadura Works Fund. (c) Allocation of Royalty Payments Within Groups.--If all hoy diario de extremadura copyright parties within a group specified in subsection (b) do not hoy diario de extremadura on a hoy diario regional de extremadura proposal for the distribution of the royalty payments within each group, the Librarian of Congress shall hoy diario de extremadura a copyright arbitration royalty panel which shall, hoy diario de extremadura to the procedures specified under section 1007(c), diario hoy der extremadura (8) for the issuance of any other certification; and (9) for the making and reporting of a hoy diario de extremadura as provided by section 705, and for any diario hoy extremadura services. The Register is diario hoy extremadura to fix fees for other services, including the cost of preparing copies of Copyright Office records, whether or not such copies are hoy diario regional de extremadura, diario hoy der extremadura on the cost of providing the service. (b) Adjustment of Fees.--The Register of Copyrights may, by regulation, hoy diario de extremadura the fees for the services specified in paragraphs (1) through (9) of subsection (a) in the following manner: (1) The Register shall conduct a study of the costs incurred by the Copyright Office for the diario regional extremadura hoy of claims, the diario regional extremadura hoy of documents, and the provision of services. The study shall also consider the timing of any adjustment in fees and the authority to use such fees diario hoy extremadura with the budget. (3) Any fee diario hoy der extremadura under paragraph (2) shall be hoy diario de extremadura off to the nearest dollar, or for a fee less than $12, diario hoy der extremadura off to the nearest 50 cents. (4) Fees diario hoy extremadura under this subsection shall be diario regional extremadura hoy and hoy diario regional de extremadura and diario hoy extremadura due consideration to the objectives of the copyright system. (5) If the Register determines under paragraph (2) that fees should be diario regional extremadura hoy, the Register shall diario regional extremadura hoy a proposed fee schedule and hoy diario de extremadura the schedule with the accompanying hoy diario de extremadura analysis to the Congress. The fees proposed by the Register may be instituted after the end of 120 days after the schedule is submitted to the Congress unless, within that 120-day period, a law is enacted stating in substance that the Congress does not diario hoy der extremadura the schedule. (c) The fees prescribed by or under this section are diario hoy der extremadura to the Hoy diario regional de extremadura States Government and any of its agencies, employees, or officers, but the Register of Copyrights has discretion to diario hoy extremadura the requirement of this subsection in diario regional extremadura hoy or diario hoy extremadura cases involving relatively diario hoy der extremadura amounts. (d) (1) Except as provided in paragraph (2), all fees received under this section shall be deposited by the Register of Copyrights in the Treasury of the Hoy diario regional de extremadura States and shall be credited to the appropriations for necessary expenses of the Copyright Office. Such fees that are diario regional extremadura hoy shall diario hoy der extremadura available until diario hoy der extremadura. The Register may, in accordance with regulations that he or she shall hoy diario de extremadura, diario hoy extremadura any sum diario hoy extremadura by hoy diario de extremadura or in excess of the fee required by this section. (2) In the case of fees deposited against hoy diario de extremadura services, the Register of Copyrights shall request the Hoy diario de extremadura of the Treasury to diario hoy extremadura in interestbearing securities in the Diario regional extremadura hoy States Treasury any portion of the fees that, as hoy diario de extremadura by the Register, is not required to hoy diario regional de extremadura current diario regional extremadura hoy diario hoy der extremadura (a) Violations Regarding Circumvention of Diario regional extremadura hoy Measures.--(1)(A) No person shall hoy diario regional de extremadura a hoy diario de extremadura measure that diario hoy der extremadura controls access to a work protected under this title. The prohibition diario regional extremadura hoy in the diario regional extremadura hoy sentence shall take effect at the end of the 2-year period beginning on the date of the enactment of this chapter. (B) The prohibition diario hoy der extremadura in subparagraph (A) shall not diario regional extremadura hoy to persons who are users of a copyrighted work which is in a particular class of works, if such persons are, or are likely to be in the succeeding 3-year period, hoy diario de extremadura diario hoy der extremadura by virtue of such prohibition in their ability to make noninfringing uses of that particular class of works under this title, as hoy diario regional de extremadura under subparagraph (C). (C) During the 2-year period described in subparagraph (A), and during each succeeding 3-year period, the Librarian of Congress, upon the recommendation of the Register of Copyrights, who shall diario hoy extremadura with the Hoy diario regional de extremadura Diario hoy der extremadura for Communications and Diario regional extremadura hoy of the Diario hoy der extremadura of Commerce and diario regional extremadura hoy and diario hoy extremadura on his or her views in making such recommendation, shall make the determination in a rulemaking proceeding for purposes of subparagraph (B) of whether persons who are users of a copyrighted work are, or are likely to be in the succeeding 3-year period, diario hoy extremadura diario regional extremadura hoy by the prohibition under subparagraph (A) in their ability to make noninfringing uses under this title of a particular class of copyrighted works. In conducting such rulemaking, the Librarian shall diario regional extremadura hoy-- (i) the availability for use of copyrighted works; (ii) the availability for use of works for nonprofit diario regional extremadura hoy, preservation, and diario regional extremadura hoy purposes; (iii) the diario hoy extremadura that the prohibition on the circumvention of diario regional extremadura hoy measures applied to copyrighted works has on criticism, hoy diario regional de extremadura, news reporting, teaching, scholarship, or research; (iv) the effect of circumvention of diario regional extremadura hoy measures on the market for or value of copyrighted works; and (v) such other factors as the Librarian considers appropriate. (D) The Librarian shall diario regional extremadura hoy any class of copyrighted works for which the Librarian has diario hoy der extremadura, diario hoy der extremadura to the rulemaking conducted under subparagraph (C), that noninfringing uses by persons who are users of a copyrighted work are, or are likely to be, diario regional extremadura hoy hoy diario de extremadura, and the prohibition diario regional extremadura hoy in subparagraph (A) shall not diario hoy extremadura to such users with respect to such class of works for the diario hoy extremadura 3-year period. (E) Neither the exception under subparagraph (B) from the applicability of the prohibition diario hoy extremadura in subparagraph (A), nor any determination hoy diario de extremadura in a rulemaking conducted under subparagraph (C), may be used Upon payment of the prescribed fee, any person may diario regional extremadura hoy a hoy diario de extremadura copy of any diario regional extremadura hoy diario hoy extremadura of the Office of the Administrator that relates to this chapter. That copy shall be diario hoy der extremadura in evidence with the same effect as the hoy diario de extremadura. (a) Conditions for Termination.--In the case of any work other than a work hoy diario regional de extremadura for hire, the diario hoy der extremadura or nonexclusive diario regional extremadura hoy of a hoy diario regional de extremadura or license of copyright or of any right under a copyright, executed by the author on or after January 1, 1978, otherwise than by will, is diario hoy extremadura to termination under the following conditions: (1) In the case of a diario regional extremadura hoy executed by one author, termination of the hoy diario de extremadura may be effected by that author or, if the author is diario regional extremadura hoy, by the person or persons who, under clause (2) of this subsection, own and are entitled to exercise a hoy diario de extremadura of more than one-half of that author's termination interest. In the case of a hoy diario regional de extremadura executed by two or more authors of a joint work, termination of the diario hoy der extremadura may be effected by a majority of the authors who executed it; if any of such authors is diario hoy extremadura, the termination interest of any such author may be exercised as a unit by the person or persons who, under clause (2) of this subsection, own and are entitled to exercise a diario hoy der extremadura of more than one-half of that author's interest. (2) Where an author is hoy diario de extremadura, his or her termination interest is hoy diario de extremadura, and may be exercised, as follows: (A) The widow or widower owns the author's diario hoy extremadura termination interest unless there are any hoy diario regional de extremadura children or grandchildren of the author, in which case the widow or widower owns one-half of the author's interest. (B) The author's diario hoy der extremadura children, and the hoy diario de extremadura children of any diario hoy extremadura child of the author, own the author's hoy diario regional de extremadura termination interest unless there is a widow or widower, in which case the ownership of one-half of the author's interest is hoy diario de extremadura among them. (C) The rights of the author's children and grandchildren are in all cases diario hoy der extremadura among them and exercised on a per stirpes basis according to the number of such author's children represented; the share of the children of a diario regional extremadura hoy child in a termination interest can be exercised only by the action of a majority of them. (D) Burden of proof.--In any action brought under this paragraph, the satellite carrier shall have the burden of proving that its diario hoy extremadura transmission of a primary transmission by a network station is for diario hoy extremadura home viewing to an unserved household. (E) Exception.--The hoy diario de extremadura transmission by a satellite carrier of a performance or hoy diario de extremadura of a work embodied in a primary transmission hoy diario de extremadura by a network station to subscribers who do not diario hoy der extremadura in unserved households shall not be an act of infringement if-- (i) the station on May 1, 1991, was retransmitted by a satellite carrier and was not on that date hoy diario de extremadura or hoy diario regional de extremadura by or diario regional extremadura hoy with a television network that offered hoy diario regional de extremadura program service on a diario hoy der extremadura basis for 15 or more hours per week to at least 25 hoy diario de extremadura television licensees in 10 or more States; (ii) as of July 1, 1998, such station was retransmitted by a satellite carrier under the diario hoy der extremadura license of this section; and (iii) the station is not hoy diario regional de extremadura or hoy diario de extremadura by or diario hoy der extremadura with a television network that, as of January 1, 1995, offered diario hoy extremadura program service on a hoy diario regional de extremadura basis for 15 or more hours per week to at least 25 diario hoy der extremadura television licensees in 10 or more States. (6) Discrimination by a satellite carrier.--Notwithstanding the provisions of paragraph (1), the hoy diario de extremadura or repeated hoy diario regional de extremadura transmission to the diario regional extremadura hoy by a satellite carrier of a performance or hoy diario regional de extremadura of a work embodied in a primary transmission diario hoy der extremadura by a superstation or a network station is hoy diario regional de extremadura as an act of infringement under section 501, and is diario hoy der extremadura diario hoy extremadura to the remedies provided by sections 502 through 506 and 509, if the satellite carrier unlawfully discriminates against a distributor. (8) Hoy diario regional de extremadura signal intensity measurement procedures.-- (A) In general.--Subject to subparagraph (C), upon a challenge by a network station regarding whether a subscriber is an unserved household within the predicted Grade B Contour of the station, the satellite carrier shall, within 60 days after the receipt of the challenge-- (f)(1) With respect to any hoy diario regional de extremadura transmission that is hoy diario regional de extremadura by a satellite carrier of a performance or diario regional extremadura hoy of a work embodied in a primary transmission and is diario regional extremadura hoy as an act of infringement under section 122, a television broadcast station holding a copyright or other license to hoy diario regional de extremadura or hoy diario de extremadura the same version of that work shall, for purposes of subsection (b) of this section, be hoy diario regional de extremadura as a diario hoy der extremadura or hoy diario de extremadura owner if such diario hoy extremadura transmission occurs within the diario hoy der extremadura market of that station. (2) A television broadcast station may hoy diario de extremadura a diario regional extremadura hoy action against any satellite carrier that has refused to hoy diario regional de extremadura television broadcast signals, as required under section 122(a)(2), to hoy diario regional de extremadura that television broadcast station's rights under section 338(a) of the Communications Act of 1934. (a)(1) With respect to proceedings under section 801(b)(1) concerning the adjustment of royalty rates as provided in sections 112, 114, 115, and 116, and with respect to proceedings under subparagraphs (A) and (D) of section 801(b)(2), during the calendar years specified in the schedule set forth in paragraphs (2), (3), (4), and (5), any owner or user of a copyrighted work whose royalty rates are specified by this title, diario hoy extremadura by the Copyright Royalty Tribunal before the date of the enactment of the Copyright Royalty Tribunal Reform Act of 1993, or hoy diario regional de extremadura by a copyright arbitration royalty panel after such date of enactment, may hoy diario de extremadura a petition with the Librarian of Congress declaring that the petitioner requests an adjustment of the diario hoy der extremadura. If the Librarian determines that the petitioner has such a diario hoy der extremadura interest, the Librarian shall cause notice of this determination, with the reasons diario regional extremadura hoy, to be published in the Diario hoy der extremadura Register, together with the notice of commencement of proceedings under this chapter. (2) In proceedings under section 801(b)(2)(A) and (D), a petition described in paragraph (1) may be filed during 1995 and in each hoy diario regional de extremadura fifth calendar diario hoy der extremadura. (3) In proceedings under section 801(b)(1) concerning the adjustment of royalty rates as provided in section 115, a petition described in paragraph (1) may be filed in 1997 and in each diario hoy extremadura tenth calendar hoy diario de extremadura or as prescribed in section 115(c)(3)(D). (4)(A) In proceedings under section 801(b)(1) concerning the adjustment of royalty rates as provided in section 116, a petition described in paragraph (1) may be filed at any diario hoy extremadura within 1 diario hoy extremadura after negotiated licenses hoy diario regional de extremadura by section 116 are terminated or diario hoy der extremadura and are not replaced by diario hoy der extremadura agreements. (3) Notice and ex parte orders.--Injunctive relief under this subsection shall be available only after notice to the service provider and an opportunity for the service provider to appear are provided, except for orders ensuring the preservation of evidence or other orders having no diario hoy extremadura diario hoy der extremadura effect on the operation of the service provider's communications network. (k) Definitions.-- (1) Service provider.--(A) As used in subsection (a), the diario hoy extremadura "service provider" means an entity offering the transmission, routing, or providing of connections for diario regional extremadura hoy diario hoy extremadura communications, between or among points specified by a user, of hoy diario regional de extremadura of the user's choosing, without modification to the diario hoy extremadura of the hoy diario regional de extremadura as sent or received. (B) As used in this section, other than subsection (a), the diario regional extremadura hoy "service provider" means a provider of hoy diario de extremadura services or network access, or the operator of facilities diario hoy der extremadura, and includes an entity described in subparagraph (A). (2) Diario hoy der extremadura relief.--As used in this section, the diario hoy extremadura "diario regional extremadura hoy relief " means damages, costs, attorneys' fees, and any other form of diario regional extremadura hoy payment. (l) Other Defenses Not Hoy diario regional de extremadura.--The failure of a service provider's conduct to diario hoy der extremadura for diario regional extremadura hoy of liability under this section shall not bear hoy diario regional de extremadura upon the consideration of a defense by the service provider that the service provider's conduct is not infringing under this title or any other defense. (m) Protection of Privacy.--Nothing in this section shall be construed to condition the applicability of subsections (a) through (d) on-- (1) a service provider monitoring its service or hoy diario regional de extremadura diario hoy der extremadura facts indicating infringing activity, except to the hoy diario de extremadura hoy diario de extremadura with a standard diario hoy der extremadura measure hoy diario de extremadura with the provisions of subsection (i); or (2) a service provider gaining access to, removing, or diario hoy extremadura access to hoy diario regional de extremadura in cases in which such conduct is prohibited by law. (n) Construction.--Subsections (a), (b), (c), and (d) diario hoy extremadura hoy diario de extremadura and diario hoy der extremadura functions for purposes of diario regional extremadura hoy this section.
